This Privacy Policy describes how Pathly LLC (owner of Pathly App) and Bentley Ventures, dba Pathly CRM (collectively, "Pathly," "we," "us," or "our") collect, use, share, and protect information through Pathly.Care, the Pathly App, and Pathly CRM.

1. Who We Are

Pathly App is owned and operated by Pathly LLC.

Pathly CRM is owned and operated by Bentley Ventures, doing business as Pathly CRM.

Both entities operate under the shared Pathly.Care brand and may share information internally to provide integrated services.

3. How We Use Information

We use collected information to:

  • Match resident care needs to appropriate communities
  • Improve search results and recommendation algorithms
  • Facilitate and schedule tours
  • Manage subscriptions and billing
  • Provide customer support
  • Monitor platform performance
  • Prevent fraud or abuse
  • Detect misuse of subscription tiers or credit systems
  • Enforce platform rules and agreements

We may use anonymized or aggregated data for analytics and system improvements.

4. Matching & Information Sharing Structure

Internal Matching

Resident profiles and care needs are used internally within the Pathly platform to generate community matches and improve placement accuracy.

Health & Care Information

Resident health information, care needs, and related sensitive data:

  • Are used internally for matching and coordination
  • Are not shared with communities through the platform
  • Are not disclosed without explicit user authorization

Contact Information Sharing

If a family member or placement professional schedules a tour or elects to connect with a community:

  • The user may choose to share contact information
  • Sharing requires affirmative user action
  • Only necessary contact and scheduling details are shared

Pathly does not automatically disclose sensitive resident information to communities.

5. Data Sharing

A. Internal Sharing Between LLCs

Information may be shared between Pathly LLC and Bentley Ventures (dba Pathly CRM) for:

  • Platform integration
  • Account management
  • Technical support
  • Operational coordination

B. With Communities

When a tour is scheduled or contact is initiated:

  • Authorized contact information
  • Scheduling details

may be shared with the selected community.

Health information and detailed care needs are not shared through the platform.

C. Payment Processing

Payments are processed securely through Stripe. Pathly does not store full credit card numbers. Stripe processes payment information in accordance with its own privacy and security policies.

D. Third-Party Providers

We may use third-party services for:

  • Cloud hosting
  • Analytics
  • Calendar integration
  • Infrastructure support

These providers process data only for authorized purposes.

E. No Sale of Personal Data

We do not sell, rent, or trade personal data to third parties for marketing or advertising purposes.

6. Calendar Integration Disclosure

If calendar integration is enabled:

We may access:

  • Event titles
  • Event date and time
  • Availability status

We do not:

  • Access private event descriptions unrelated to scheduling
  • Read personal communications
  • Modify calendar entries without user action

Calendar access is used solely for scheduling coordination.

7. Auto-Replenish Disclosure (Community Tiers)

For Community accounts:

  • Credits may automatically replenish when balance falls below a designated threshold.
  • Auto-replenish may be enabled by default.
  • Users may disable this feature within account settings.
  • Billing notifications are sent via email in connection with charges.
  • All charges are processed via Stripe.

8. Data Retention

  • Resident profiles are retained while accounts remain active and up to 24 months after inactivity unless deletion is requested.
  • Inactive accounts may be deactivated after 12 months.
  • Billing records are retained as required by law.
  • Upon account termination, personal data is deleted or anonymized within a reasonable timeframe unless legally required to retain it.

9. Data Security

We implement reasonable technical and organizational safeguards. No system can guarantee absolute security.

Users are responsible for maintaining account credential confidentiality.

10. User Rights

Subject to applicable law, users may:

  • Request access to personal data
  • Request correction of inaccurate information
  • Request deletion of data
  • Withdraw consent where applicable

11. SMS Opt-In & Consent

SMS Communications and Consent

If you provide your mobile phone number through our website, forms, or through a senior living community using PathlyCRM, you may receive SMS or MMS messages related to:

  • Appointment reminders
  • Tour scheduling and confirmations
  • Lead follow-ups from senior living communities
  • Customer support messages
  • Account or service notifications

By providing your mobile phone number and opting in, you consent to receive text messages from PathlyCRM or from senior living communities using our platform.

Consent to receive SMS messages is not a condition of purchasing any services.

SMS Opt-Out Instructions

You may opt out of receiving SMS messages at any time. To stop receiving messages, reply:

After you send STOP, you will receive one confirmation message and will no longer receive SMS messages unless you opt in again.

Mobile Information Sharing Disclosure

We respect your privacy.

  • Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
  • Text messaging originator opt-in data and consent will not be shared with any third parties except for messaging service providers and carriers required to deliver the SMS service.
  • All the above categories exclude text messaging originator opt-in data and consent.
